Well, the short answer is we have different standards for adults and children. Of course, its not nearly so cut and dried as you suggest. Many minors are tried as adults these days. Unfortunately that decision seems to be based on shifting criteria resulting in a very uneven application of the law.

Most teenagers accused of murder these days are tried as an adult. In Texas an 11-year-old was tried as an adult.

Kids younger than that (or a little older than that in more sane states) will be locked up until they're 18, then their records expunged. But it depends. If the crime was really serious and they can make a case that the kid knew what he was doing, he can get life in prison.

Depends on the age of the child and how the crime was committed. Do you really think the 7 year old who brought a gun to school and killed a little girl should spend the rest of his life in jail?
